 Cary Nature is committed to respecting the privacy of our donors.    Information Collected.  Here are the types of donor information that we collect and usually dont maintain beyond requirement, unless participant agrees to sign up:   contact information:  name, organization/company, complete address, phone number,  email address  generally exclude with option to include  donation information: amounts donated, date of donation(s), method and stimulus  regular record maintaince  information concerning hours you have volunteered   your requests and comments   information gathered from database modeling firms   non-personally identifiable information, such as cookies,=. This requires that a ‘cookie’ be sent to your  web browser.   How Information is Used.  Cary Nature uses your data to maintain records of  donations, send acknowledgements, mail year-end tax statements to you, send newsletters,  notices and direct mail pieces, and for internal marketing purposes.   We normally add you to our mailing list, unless you request otherwise. Our third-party mailing  service is contractually obligated to treat the lists with confidentiality and is prohibited from  transferring them elsewhere.  We do NOT list individuals’ names in ANY of our publications. Corporate and Foundation  sponsors are listed in our Annual Report and event programs.  We use your written comments/letters occasionally to post on our website (in an anonymous  fashion), and to respond to your inquiries.   Credit card numbers are NOT retained once processed. Our website has a SSL certificate.  Donations over 2% of our entire budget must be reported on IRS Form 990, Schedule B.  We use website statistics to analyze our website usage. If you create a personal URL at  carytownnature.org, that information is used to personalize your internet experience.  No Sharing of Personal Information. Cary Town Nature will not sell, rent, trade or  transfer your personal information to outside organizations.  Use of donor information will be  limited to the internal purposes of Cary Town Nature and only to further the mission . Nevertheless, security measures may not prevent all losses, and Cary Town Nature is  not responsible for any damages or liabilities relating to security  failures, but the charity is insured.  Removing Your Name From Our Mailing List. This website is owned and operated by CaryTown Nature. Please read these Terms of Use ("Terms of Use") and our Privacy Policy

The Terms of Use govern all pages hosted at www.carytownnature.org , including all sub-domains hosted through our top-level domains and those hosted through our online donation and eCommunity areas (collectively, "the Sites"), as well as donor information that may be provided to Cary Town Nature via other means.

These Terms of Use do not apply to pages hosted by other organizations, to which we may link and whose privacy and other policies may differ.  The use of the Sites is conditioned upon acceptance of these Terms of Use, including our Privay Policy, and your use of any of the Sites constitutes your agreement with these Terms of Use. These Terms of Use may change from time to time, so please check back periodically. Your continued use of the Sites following any such changes will constitute your agreement with the amended Terms of Use.

The safety of children is very important to us. Our Sites are not intended for children younger than 13 and we do not intend to collect personally identifiable information from children. Children should always ask a parent for permission before sending personal information to anyone online.

You agree that we shall not be liable to you or any third party for any termination of your access to any of the Sites or for removal of information from the Sites.

IN NO EVENT WILL CARY TOWN NAUTRE OR ITS AFFILIATES BE LIABLE FOR ANY DAMAGES INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR ANY OTHER DAMAGES WHATSOEVER ARISING FROM THE USE OF OR IN CONNECTION WITH SUCH USE OR LOSS OF USE OF ANY OF THE SITES, WHETHER THE ALLEGED LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR ANY OTHER BASIS, EVEN IF CARY TOWN NATURE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, THIS EXCLUSION OF LIABILITY IN SUCH JURISDICTIONS SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW.

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, AND TO THE EXTENT THAT A JUDGMENT IS RENDERED IN A COURT OF COMPETENT JURISDICTION DISREGARDING ONE OR MORE OF THE WARRANTY DISCLAIMERS AND LIABILITY LIMITATIONS CONTAINED HEREIN, CARY TOWN NATURE’S AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100)

Cary Town Nature does not warrant that the Sites or the functions contained in the material of the Sites will be uninterrupted or error-free, that defects will be corrected, or that the Sites or the server making the Sites available are free of viruses or bugs or represents the full functionality, accuracy, and reliability of the materials.

Cary Town Nature Sites use various Cary Town Nature trademarks that are protected by state and federal laws. Other trademarks appear on the Sites with permission from their respective owners. All rights in these marks are reserved to their owners. Nothing on the Sites should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark or other mark displayed on the Sites, without the owner's prior written permission for each specific use.

The Sites may be used solely for personal, informational and noncommercial purposes. As indicated on certain pages of the Sites, the Sites contain materials that have been developed for fundraising, advocacy or educational purposes and that are intended for download, printing and distribution. Documents may be copied for these noncommercial uses only on the condition that any copyright and source indications are also copied, no modifications are made and the document is copied in its entirety. You may not otherwise modify, copy, distribute, transmit, display, post, reproduce, publish, create derivative works from, transfer or sell any pages, data, information, or services obtained from the Sites unless you have the prior written consent of Cary Town Nature and any other applicable owner of the Sites content. As noted, the Sites may contain links to other websites. All such links are provided as a convenience to our users. Cary Town Nature takes no responsibility for the content of external websites.

Any communication or material that you transmit to, or post on, any public area of the Sites, including any data, questions, comments, suggestions, or the like, (collectively, “User Content”) is, and will be treated as, non-confidential and non-proprietary information.  You hereby grant to Cary Town Nature a nonexclusive, royalty free, perpetual, irrevocable right and license to reproduce, display, distribute and modify all such User Content for the purposes of operating the Sites and to provide the services referenced in the Sites.

You are solely responsible for maintaining the confidentiality of any account information, user names, access permissions or passwords that you use to access the Sites or any portion thereof. You agree to accept responsibility for all activities occurring under your accounts, user names or passwords that are due to your conduct, inaction or negligence. If any provision of these Terms of Use is deemed unlawful, void or for any reason unenforceable, that provision will be deemed severable from these Terms of Use and will not affect the validity and enforceability of the remaining provisions.

By using the Cary Town Nature Sites, you agree to indemnify, hold harmless, and defend Cary Town Nature, its affiliates, and their respective directors, officers, employees, successors, agents, partners, contractors, and vendors (collectively, the "Cary Town Nature Parties") from any claims, damages, losses, liabilities, and all costs and expenses of defense, including but not limited to, attorneys' fees, resulting directly or indirectly from a claim (including without limitation, claims made by third parties for infringement of intellectual property rights) that arise in connection with (i) your use or misuse of any of the Sites; (ii) your breach of these Terms of Use; or (iv) your violation of any law or the rights of a third party. You agree to cooperate as fully as reasonably required in the defense of any claim. Cary Town Nature reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you for which you will remain responsible for indemnifying and holding harmless the Cary Town Nature Parties.

The Sites are administered by Cary Town Nature from its offices in North Carolina, United States of America. These Terms of Use shall be governed by and construed in accordance with the laws of North Carolina. You agree that any disputes relating to or arising out of the use of any of the Sites or any transaction undertaken through the Sites shall be subject to the exclusive jurisdiction of the federal or state courts located in Orange or Wake Counties.

If you do not accept these Terms of Use and the Privacy Policy in full, you must immediately terminate use of the Sites.

IN PERSON EVENTS AND ATTENDANCE

By attending events, you acknowledge that the risks of illness, bodily injury, and property damage or loss, risk of arrest and detention, are inherent in your participation. You assume all such risks and agree not to hold Cary Town Nature or any of their respective directors, officers, employees, agents, contractors, or volunteers responsible for any personal injury, property damage, or other losses of any kind that result from your participation in the Event.

You further acknowledge that you may appear in photos, videos, and other recordings made at the Event (collectively, “Recordings”), and you agree that Cary Town Nature may use and allow others to use any such Recordings for any lawful purpose.

Notwithstanding any rules and guidelines issues by Cary Town Nature you acknowledge and agree that you are not an employee, agent, or other representative of Cary Town Nature and that (you are) participating in your individual capacity. You further acknowledge that you will not be entitled to assistance from Cary Town Nature if you are arrested, detained, or otherwise harmed while participating in the Event.
